Welcome to PauseKit! These Terms of Service ("Terms") govern your use of the PauseKit platform. By creating an account and using our services, you agree to these Terms.

PauseKit is operated by OuttaBoxes LLC.

1. Acceptance of Terms

By accessing or using PauseKit, you agree to:

• Be bound by these Terms of Service
• Comply with our Privacy Policy
• Use the platform responsibly and lawfully
• Be at least 18 years of age

If you do not agree to these Terms, you may not use PauseKit.

2. Miranda AI Coach and Medical Disclaimer

You understand and agree that:

• Miranda is designed to provide general wellness information, emotional support, and educational content about menopause
• Miranda cannot diagnose medical conditions, prescribe medications, or provide treatment recommendations
• You should always consult with a qualified healthcare provider before making decisions about your health, medications, or treatment plans
• In case of a medical emergency, call 911 or your local emergency services immediately — do not rely on Miranda
• Miranda's responses are generated by AI and may contain errors or inaccuracies

3. User Responsibilities

As a PauseKit user, you agree to:

• Accurate Information: Provide truthful and accurate information when creating your account
• Account Security: Keep your password secure and notify us immediately of any unauthorized access
• Proper Use: Use the platform only for its intended purpose (personal wellness tracking and support)
• No Misuse: Not attempt to hack, reverse-engineer, or disrupt the platform
• Respect Others: Not use the platform to harass, spam, or harm other users

4. Membership and Billing

Free Trial

• PauseKit offers a free trial for new users (3 days for standard signups; 7 days for exclusive partner offers)
• You can cancel anytime during the trial without being charged
• After the trial, your membership will automatically convert to a paid subscription unless you cancel

Paid Membership

• PauseKit membership costs $17/month
• Your subscription automatically renews each month until you cancel
• You will be charged on the same day each month
• You can cancel your subscription at any time from your account settings
• No refunds for partial months — you retain access until the end of your billing period

Payment

• We accept major credit cards and debit cards
• All payments are processed securely through Stripe
• If a payment fails, we will notify you and may suspend your account until payment is resolved
• Prices are subject to change with 30 days' notice

5. Acceptable Use Policy

You may NOT use PauseKit to:

• Violate any laws or regulations
• Impersonate another person or entity
• Upload malware, viruses, or harmful code
• Scrape, copy, or distribute our content without permission
• Use the platform for commercial purposes without authorization
• Share your account with others (accounts are for individual use only)
• Attempt to bypass security measures or access restricted areas

6. Intellectual Property

All content and materials on PauseKit are protected by copyright and other intellectual property laws:

• Our Content: All text, graphics, logos, designs, features, and functionality are owned by PauseKit and may not be copied or distributed without permission
• Your Content: You retain ownership of the health data and information you input into PauseKit. By using the platform, you grant us a license to use this data to provide our services (e.g., generating insights, displaying trends)
• Feedback: If you provide feedback or suggestions, we may use them without compensation or obligation to you

7. Limitation of Liability

To the maximum extent permitted by law:

• PauseKit is provided "AS IS" without warranties of any kind, express or implied
• We do not guarantee that the platform will be error-free, uninterrupted, or secure
• We are NOT liable for any health outcomes, medical decisions, or injuries resulting from your use of PauseKit
• We are NOT liable for lost data, lost profits, or indirect damages
• Our total liability to you for any claims is limited to the amount you paid us in the past 12 months

8. Account Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms of Service
• You engage in fraudulent or illegal activity
• Your account remains inactive for an extended period
• We need to comply with legal requirements

9. Data and Privacy

Your use of PauseKit is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your data.

10. Changes to These Terms

We may update these Terms from time to time. When we do:

• We will notify you via email and update the "Last Updated" date
• Significant changes will be announced with a 30-day notice period
• Continued use of PauseKit after changes constitutes acceptance of the new Terms
• If you don't agree with the changes, you may cancel your account

11. Dispute Resolution

If you have a dispute with PauseKit:

• First, contact us at pausekit@polsia.app to try to resolve it informally
• If we cannot resolve it, you agree to binding arbitration (not court litigation) in accordance with the laws of the State of Arkansas, USA
• Class action lawsuits are waived — disputes must be brought individually

12. Miscellaneous

• Governing Law: These Terms are governed by the laws of the State of Arkansas, USA
• Severability: If any provision is found invalid, the rest of the Terms remain in effect
• Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and PauseKit
• No Waiver: Our failure to enforce a term does not waive our right to enforce it later
